Abstract: the relativity of obligation or contract originated from Jus romanum has been an important principle and contributed much to the civil law .But in the process of its development ,there has been some exception against it in order to meet the needs of social development ,including subrogation、performance by the third party etc. This article made a brief retrospect and comment on these.
